Terms of Service

These terms apply when you use wallandwag.com. Wall & Wag is a brand of Sharafiev Design Inc., a New York corporation ("we", "us"). By uploading a photo or placing an order, you agree to what follows.

1. Who can order

You must be at least 18 years old and able to enter into a contract. We currently sell and ship within the United States only.

2. Your photo, and the rights you need to have

You keep ownership of the photo you upload. By uploading it, you grant us a limited licence to store it and process it — including sending it to our AI providers — for the purpose of creating your previews and your finished artwork.

You confirm that you have the right to use the photo. That means you took it, or you have permission from whoever did. Do not upload photos you found online, professional photographs you do not have a licence for, or images containing other people without their consent. You are responsible for claims arising from photos you did not have the right to submit.

We may refuse or remove any upload that appears unlawful, infringing, or that our providers' safety systems reject.

3. How the artwork is created

Portraits are generated using artificial intelligence and then reviewed by a human before printing. Because generative AI is not deterministic:

  • results vary between runs, and the same photo will not produce an identical image twice;
  • the artwork is an interpretation of your pet, not a photographic reproduction, and small differences in markings, fur or proportions are normal;
  • the quality of the result depends heavily on the source photo — a sharp, well-lit photo produces a better portrait.

We do not guarantee an exact likeness. You see your previews before you pay, so you can decide whether the result is right for you.

4. Previews, pet projects and pricing

  • Creating previews is free; you pay only when you order.
  • Your first pet project is included at no charge and covers all eight styles in every format. Adding another pet (a new photo) costs $5, charged before generation.
  • Prices are shown in US dollars on the site and may change at any time; the price shown at checkout is the price that applies to your order.
  • Promotional codes apply to artwork only and never reduce shipping charges. Codes may be limited in quantity or time and can be withdrawn.
  • Previews are watermarked and are for review only. Removing or circumventing the watermark, or using a preview commercially, is not permitted.

5. Payment

Payments are processed by Stripe. We never receive your card details. By ordering, you authorise the charge shown at checkout, plus any applicable sales tax.

6. What you may do with your artwork

Once your order is paid, you receive a perpetual, worldwide licence to use your finished portrait for personal, non-commercial use: printing it, hanging it, sharing it on social media, giving it as a gift.

You may not resell the artwork, use it on merchandise for sale, or use it to train an AI model. We retain ownership of our art styles, prompts, website and brand — a portrait of your pet does not transfer rights in the underlying style.

7. Production, delivery and risk

Orders are printed in Brooklyn. Estimated turnaround is 1–2 business days before dispatch or pickup; these are estimates, not guarantees, and carrier delays are outside our control.

Shipping is charged at the live carrier rate. Title and risk of loss pass to you on delivery to the carrier — if a package is lost or damaged in transit, we will still help you and, per our Refund Policy, reprint or refund.

You are responsible for providing an accurate address. Packages returned because of an incorrect address require a new shipping charge to resend.

8. Refunds

Custom items are not returnable for change of mind; damaged, defective or incorrect orders are reprinted or refunded at our cost. The full terms are in our Refund & Return Policy, which forms part of these terms.

9. Acceptable use

You agree not to:

  • upload unlawful, hateful, sexual or violent content;
  • attempt to access other customers' sessions, artwork or order data;
  • interfere with, overload, scrape or reverse-engineer the service; or
  • abuse promotional pricing, for example by manipulating the free pet project allowance.

We may suspend or refuse service, and cancel orders with a refund, if these terms are breached.

10. Disclaimers

The service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free, or that any AI-generated result will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to your order or the service is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages, including lost profits or the sentimental value of a photograph.

Nothing in these terms limits liability that cannot be limited by law.

12. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction.

13. Changes to these terms

We may update these terms; the date above shows the current version. The terms in force when you place an order are the ones that apply to that order.
